Terms of service for Mint Help and connected messaging channels

These terms govern use of Mint Help, the Chatwoot CRM workspace, and integrations such as WhatsApp that are connected through the platform.

1. Acceptance of these terms

These Terms of Service govern access to and use of minthelp.app, chat.minthelp.app, and the Mint Help customer communication platform powered by Chatwoot CRM. By accessing or using the service, you agree to these terms on behalf of yourself or the organization you represent.

If you are using Mint Help for a business, you represent that you have authority to bind that business to these terms.

2. The service

Mint Help provides software and related services that help teams manage customer conversations across channels including web chat, email, WhatsApp, Instagram, and Facebook Messenger. Features may change from time to time as the product evolves, improves, or responds to technical, legal, or platform requirements.

We may offer access through hosted infrastructure, connected third-party integrations, and supporting websites, documentation, and onboarding resources.

3. Accounts and access

You are responsible for maintaining the confidentiality of your login credentials, managing workspace access, and ensuring that only authorized users access your account.

You must provide accurate registration and account information and keep it reasonably up to date. You are responsible for activity that occurs under your account or workspace unless caused solely by our breach of these terms.

4. Acceptable use

You may not use Mint Help to violate law, infringe intellectual property or privacy rights, transmit malware, interfere with the service, engage in fraud, impersonation, harassment, or abuse, or send unlawful, deceptive, or unsolicited communications.

You may not use the service for spam, illegal marketing, prohibited financial schemes, unlawful adult content, or any activity that would cause Mint Help, Chatwoot CRM, WhatsApp, Meta, or connected providers to violate applicable rules or platform policies.

5. WhatsApp, Meta, and third-party platforms

If you connect WhatsApp or other Meta services to Mint Help, you remain responsible for complying with all applicable Meta, WhatsApp Business Platform, and other third-party platform terms, policies, messaging rules, consent requirements, and commerce restrictions.

You must obtain any permissions, notices, or consents required to contact end users, and you must only send content that is lawful, accurate, and permitted by the applicable platform. Mint Help may limit, suspend, or remove access to integrations where needed to address platform, legal, security, or abuse concerns.

6. Customer data and your responsibilities

As between the parties, you retain responsibility for the customer, contact, and conversation data you or your users submit to the service. You represent that you have the rights and lawful basis needed to collect, use, process, and instruct Mint Help to process that data on your behalf.

You are responsible for your workspace settings, retention choices, internal user permissions, and compliance obligations applicable to your business, industry, and region.

7. Availability, changes, and support

We work to provide a reliable service, but availability may be affected by maintenance, incidents, internet outages, hosting issues, or third-party platform changes. We may modify, suspend, or discontinue features where reasonably necessary.

Nothing in these terms guarantees uninterrupted availability, specific uptime levels, or continued access to any integration that depends on a third-party provider.

8. Fees and billing

If you purchase a paid plan, you agree to pay applicable fees, taxes, and charges under the pricing and billing terms presented to you at the time of purchase. Unless otherwise stated, fees are non-refundable except where required by law or expressly agreed in writing.

We may change pricing for future billing periods by providing reasonable notice where required.

9. Suspension and termination

We may suspend or terminate access to the service if we reasonably believe you have violated these terms, created security risk, failed to pay applicable fees, or used the platform in a way that could expose Mint Help or its providers to legal, reputational, or technical harm.

You may stop using the service at any time. Provisions that by their nature should survive termination, including payment obligations, disclaimers, limitations of liability, and compliance responsibilities, will survive.

10. Intellectual property

Mint Help and its licensors retain all rights, title, and interest in the service, software, branding, documentation, and related materials, excluding your own data and content. These terms grant you a limited, non-exclusive, non-transferable right to use the service in accordance with these terms.

You may not copy, resell, sublicense, reverse engineer, or misuse the service except to the extent such restriction is prohibited by applicable law.

11. Disclaimers and limitation of liability

To the maximum extent permitted by law, the service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Mint Help will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business opportunity arising from or related to the service. Our aggregate liability for claims arising out of or related to the service will not exceed the amounts paid by you to Mint Help for the service during the twelve months before the event giving rise to the claim.

12. Changes to these terms and contact

We may update these Terms of Service from time to time. When we do, we will update the effective date on this page. Continued use of the service after updated terms become effective constitutes acceptance of the revised terms.
